Research Products Corporation (“RPC,” “we” or “us”) has built its reputation and brands on a foundation of trust. This privacy policy (“Policy”) describes how we collect, use, disclose and store information, including Personal Information. This policy applies to your use of the Aprilaire Wi-Fi thermostat, the Aprilaire thermostat mobile application and the Aprilaire online portal (collectively the “Services”). By enrolling or using any of the Services, you are agreeing to this Policy. If you do not agree with this Policy, do not use any of the Services and do not submit any Personal information to RPC.


Use Restricted To United States Residents


The Services are hosted on servers located in the United States of America and are intended for use only by United States and Canadian residents.  You may not use the Services is you are not a United States or Canadian resident.  


Children


The Services are not intended for children under 13 years of age.  RPC does not knowingly collect personal information from children under 13.


What Type Of Information Do We Collect?


Personal Information

Personal Information” is any information that reasonably relates to a living, identifiable human being, and may include such things as names, addresses, zip code, contact details, telephone numbers and email addresses. Non-identifying information that we may collect about you (such as age, gender, race, etc.) will be treated as Personal Information if it is linked to you. We collect Personal Information when you enroll in the Services and when you provide it to us throughout the course of the Services. For example, we may obtain Personal Information from you when you complete a form or survey, register an account, email us, or make a posting within the Services. 

System Data

System Data” is information (other than Personal Information) that we collect as you use the Services. System Data includes such things as thermostat settings and schedules, serial numbers, device identification numbers, malfunctions, operational information, HVAC control patterns and details about your HVAC system. We collect System Data directly from you and your HVAC system through your Wi-Fi and Internet services. We may combine System Data with other third party data, such as local weather conditions. If any System Data is combined with Personal Information, the combined information will all be treated as Personal Information.
Analytics Data

Analytics Data” is information that we collect about how you use and interact with the Services, and the patterns in such information. Analytics Data may be collected through your use of the Services from your computer, website, thermostat, software, and the Aprilaire mobile application. Analytics Data may include details about your visits to our website, your use of our mobile application, the features and functions that you access, date and time stamps, internet protocol (IP) addresses, website links, activity logs and error logs, and information about your use of our Services. We use technologies, such as cookies and web beacons, to collect information about the pages you view, the links you click and other actions you take on the Aprilaire mobile application and website. We may also create additional Analytics Data from the analysis of collected Personal Information, System Data and Analytics Data. If any Analytics Data contains your Personal Information, the combined information will be treated as Personal Information.


How Do We Use Information That We Collect?

We collect and use Personal  Information, System Data and Analytics Data to provide Services to you and to operate and improve the Services that you receive. We use System Data and Analytics Data to improve our Services (such as adding new features and functionality) and may also use it to create additional services. These uses include providing you with the Services; processing and collecting payments; providing you with customer service; improving the user interface and experience of the Services; providing technical support; and performing research and analysis to develop and improve products, services and technologies. By using the Services, you acknowledge and consent to us sending certain communications to you such as welcome letters, alerts, information on technical service issues, and security announcements by e-mail, text message and through the Services. Because these types of communications are necessary for us to perform the Services, you can only opt out of these communications by terminating the Services as well. 

We may also provide you with information on our news and current developments, announcements, new products and services, changes to our products and services, and upcoming events. You may opt out of receiving these types of communications without terminating the Services. These communications may be sent by e-mail, text message, or within the Services. We may also use your Personal Information in connection with System Data and Analytics Data to conduct research, analysis or studies for our own purposes. For example, when we collect information about your HVAC system, it may initially contain your Personal Information and we may redact such Personal Information from the System Data and Analytics Data, then aggregate it with the non-personal data from other users, and then use the combined results across our products and services. We may also license, sell or publish compiled System Data and Analytics Data that has been incorporated into our products and services, provided that all of your Personal Information has been removed from such System Data and Analytics Data. We may also use your information for other purposes with your consent, or as permitted or required by law.


How Do We Protect Your Information?


We employ commercially reasonable security measures, technologies and procedures to protect all information stored within our Services from unauthorized access, use, or disclosure. However, despite these efforts, we cannot guarantee the security of stored information. Accordingly, to the maximum extent permitted by applicable law, we hereby disclaim all liability for any disclosure of data due to errors in transmission, unauthorized third party access or other acts of third parties, or acts or omissions beyond our control.


When May We Share Personal Information And System Data That We Have Collected With Third Parties?


Providing the Services

With your authorization, we may share your Personal Information and System Data with third parties within the Services, or as required for us to perform the Services. For example, if you make a purchase using the Services, we would share your Personal Information to the extent necessary to process the payment. We may also share your Personal Information with your prior consent.  

As required by Law

We may disclose specific Personal Information: (i) following a lawful request, in response to a legal process and when we are legally required to do so; (ii) to enforce our rights in connection with the Services that we provide; (iii) to protect the rights, property or safety of RPC’s employees, agents, and customers.

Mergers and acquisitions

If RPC is involved in a merger, acquisition, refinancing transaction or sale of assets or any other situation involving the transfer of some or all of RPC’s business assets, we may disclose your Personal Information to those involved in the negotiation or transfer.

Canadian Residents

The file containing your Personal Information and System Information will be electronically maintained on our servers or the servers of our service providers that are located outside of Canada. Our authorized employees and agents who require access to your Personal Information and System Information to perform their job functions will have access to this information.
